Terms of Service

By accessing or using Trainer APP ("Service", "we", "us", or "our") — including any associated websites, mobile applications, or APIs — you ("User", "Gym Owner", "Member") agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service.

These Terms constitute a legally binding agreement between you and Trainer APP (operated by Designs Lab Pro, India). We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance.

Trainer APP is a gym management CRM platform that allows gym owners, coaches, and trainers to manage member profiles, track attendance, process payments, monitor fitness goals, and communicate with members. The Service is provided on a subscription basis.

Access to specific features depends on your subscription plan (Starter, Professional, or Enterprise). We reserve the right to modify, suspend, or discontinue any part of the Service with or without notice.

Gym accounts are created by Trainer APP administrators. Member accounts are created by gym owners or through an invitation link. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must provide accurate, current, and complete information. You must be at least 18 years old to create a gym account. You must notify us immediately of any unauthorized use of your account at support@trainerapp.in.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or harm other users.

Trainer APP offers subscription plans billed monthly or annually. All fees are exclusive of applicable taxes. Payment must be made in advance for each billing cycle.

Failure to pay may result in suspension of your account. Refunds are not provided for partial billing periods unless required by applicable law. Plan upgrades take effect immediately; downgrades take effect at the next billing cycle.

We reserve the right to change pricing with 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe the intellectual property rights of others
• Upload or transmit malicious code, spam, or harmful content
• Attempt to reverse engineer, decompile, or disassemble the Service
• Resell, sublicense, or redistribute the Service without our written consent
• Use the Service for any purpose other than managing your gym business
• Collect or harvest personal data of other users without consent

Violation of these restrictions may result in immediate termination of your account without refund.

Gym owners are responsible for obtaining appropriate consent from their members before entering their personal data into the Service. You represent that you have the right to upload and process all data you submit to Trainer APP.

We process personal data in accordance with our Privacy Policy. You, as a gym owner, act as a data controller for your members' data; we act as a data processor. You must comply with all applicable data protection laws in your jurisdiction.

The Service, including all software, design, content, logos, and trademarks, is the exclusive property of Trainer APP and protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service solely for its intended purpose during your subscription period. No ownership rights are transferred to you.

Any feedback, suggestions, or improvements you provide may be used by us without compensation or attribution.

While we strive to maintain 99.9% uptime and perform regular backups, we do not guarantee uninterrupted access or that the Service will be free from errors. Scheduled maintenance may cause temporary unavailability.

We recommend that gym owners export their data periodically. We are not liable for data loss resulting from technical failures beyond our reasonable control.

To the maximum extent permitted by law, Trainer APP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunities arising out of or related to your use of the Service.

Our total cumulative liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the three (3) months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will meet your requirements, that results will be accurate, or that defects will be corrected.

You may terminate your account at any time by contacting support@trainerapp.in. Termination does not entitle you to a refund of any prepaid fees.

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Service ceases immediately. Your data may be retained for up to 90 days after termination before being permanently deleted.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts located in India.
